Brea Consumer Health Data Privacy Policy

Brea does not sell consumer health data, use it for advertising, or disclose identifiable consumer health data to employers, managers, or human resources.

1.Scope

This Policy provides the consumer-health disclosures required by applicable US state laws. It supplements Brea’s Privacy Policy, which explains Brea’s broader privacy practices. “Consumer health data” means personal information that identifies or can reasonably be linked to you and relates to physical or mental health, reproductive or sexual health, healthcare, or an inference about health.

2.Consumer health data Brea may collect

Depending on what you provide and the features you use, Brea may collect or infer:

  • menopause, hormonal, period, cycle, reproductive-health, symptom, sleep, energy, pain, mood, stress, anxiety, recovery, medication, hormone-therapy, surgery, treatment, and daily-functioning information;
  • Capacity Profile responses, daily responses, monthly reflections, behaviors, demands, recovery information, and private conversations that reveal health information; and
  • Capacity States, patterns, correlations, trends, and other health-related inferences generated by Brea.

Brea does not collect precise location for these purposes. Country or approximate region may be used for legal compliance and, after confirmation, localization of safety resources.

3.Sources and purposes

Brea collects consumer health data directly from you, from your use of the Service, and from information Brea generates or infers from those sources. Employers do not provide Brea with your health information.

Brea uses this information to:

  • provide and personalize Capacity Intelligence; generate Capacity Profiles, Capacity States, patterns, reports and suggestions;
  • conduct Talk to Brea conversations; display human-support options after a voluntary safety disclosure;
  • secure, support, evaluate and improve the Service;
  • create anonymous aggregate program reporting for groups of at least 10 users;
  • comply with law; and establish or defend legal rights.

4.Disclosures

Brea may disclose consumer health data only to:

  • processors supporting hosting, security, authentication, AI processing, analytics, communications and support under contractual restrictions;
  • a person or service you direct, such as when you download and share a report;
  • a successor in a financing, restructuring, merger, acquisition or sale, subject to protections required by law; or
  • authorities or other parties when disclosure is required by binding law or valid legal process, or otherwise expressly permitted by law.

Brea does not sell consumer health data, share it for cross-context behavioral advertising, use it for advertising, or permit advertising trackers inside authenticated health and conversation areas. Employer reports are anonymous and aggregated across at least 10 users, with additional suppression where needed.

5.Consent and your rights

Where required, Brea obtains consent before collecting or processing consumer health data. You may withdraw consent, but this may prevent Brea from providing features that rely on the information.

Subject to applicable law and verification, you may:

  • confirm whether Brea collects, shares or sells consumer health data about you;
  • access it and obtain a copy;
  • obtain the categories of recipients and, where required, a list of specific third parties that received it;
  • correct inaccurate information;
  • withdraw consent;
  • request deletion, including from applicable processors;
  • appeal a refusal to act; and
  • exercise these rights without discrimination.

6.Requests, deletion and appeals

Use available account controls or email info@therecalibrateprogram.com. Brea may verify your identity and authority. Brea will respond within the period required by applicable law and explain any lawful extension or denial and the available appeal process.

You may delete your account at any time. Brea begins deletion promptly and deletes or deidentifies active consumer health data within 30 days, subject to limited legal and security exceptions. Residual encrypted backups are deleted or overwritten within 90 days and are not restored to ordinary use. Where required, Brea notifies relevant processors and other recipients of a valid deletion request.

7.Changes and contact

If Brea materially changes its consumer-health practices, it will provide notice and obtain consent where required. The current version will be available through a separate and distinct Consumer Health Data Privacy link.
